Terms of Use
Chapter 1. General Provisions
Article 1. Purpose
These Terms of Use set forth the rights, obligations, responsibilities, and other necessary matters between users and Ronald McDonald House Korea in connection with the use of services provided through the Ronald McDonald House Korea website.
Article 2. Effectiveness and Amendments
These Terms of Use become effective when they are posted on the website or otherwise made available to users and a user agrees to them when registering for an account.
Ronald McDonald House Korea may amend these Terms of Use where there is a reasonable basis to do so, provided that such amendments do not violate applicable laws and regulations. Any amended Terms of Use will become effective upon being posted on the website.
However, any material changes affecting the rights or obligations of users will be announced at least seven (7) days in advance.
Users who do not agree to the amended Terms of Use may request deletion of their account.
Article 3. Matters Not Covered by These Terms
Any matters not expressly provided for in these Terms of Use will be governed by applicable laws and regulations, including the Framework Act on Telecommunications and the Telecommunications Business Act, as well as generally accepted practices.
Article 4. Definitions
For purposes of these Terms of Use, the following terms have the meanings set forth below:
1. User: An individual or corporate user who agrees to these Terms of Use and the collection and use of personal data and completes account registration on the website, including individual users, corporate users, and social login users.
2. User ID: A combination of letters and numbers selected by an individual or corporate user and approved by Ronald McDonald House Korea for user identification and access to services.
3. Password: A combination of characters and numbers created by an individual or corporate user to protect the user's account information.
4. Administrator: A person designated by Ronald McDonald House Korea to manage and facilitate the overall operation of the services.
5. Service Suspension: The temporary suspension of services for a specified period in accordance with conditions determined by Ronald McDonald House Korea.
6. Social Login User: An individual user who registers for and logs in to an account using a Kakao or Naver account.
Unless otherwise defined above, terms used in these Terms of Use will have the meanings prescribed by applicable laws and regulations or the relevant service guidelines.
Chapter 2. Service Use Agreement
Article 5. Formation of the Service Use Agreement
1. A user will be deemed to have agreed to these Terms of Use by selecting the "Agree" button in response to the question, "Do you agree to the Terms of Use?" during the account registration process.
2. A user who wishes to register for an account and use the services must provide the information required by Ronald McDonald House Korea for account registration.
Article 6. Account Registration
Users must provide the following information through the account registration form:
1. Individual Users
• Name
• Date of birth
• Gender
• Mobile phone number
• User ID
• Password
• Email address
• Address
2. Corporate Users
• Company name
• Contact person's name
• Contact number
• Contact person's email address
• User ID
• Password
• Address
• Business registration number
3. Social Login Users
• Social account identifier and email address provided by
Kakao or Naver
• Where such information is not provided by the relevant
social platform, name, date of birth, gender, mobile phone
number, and email address
4. Other information deemed necessary by Ronald McDonald House Korea
Article 7. Acceptance of Account Registration
Ronald McDonald House Korea will accept an account registration request where the user has accurately provided the information required under Article 6.
Article 8. Restrictions on Account Registration
Ronald McDonald House Korea may reject or cancel an account registration request in any of the following circumstances:
1. Where it is technically impossible to provide the services;
2. Where false information is provided during registration, including where a user does not use their real name or uses another person's identity;
3. Where required registration information is omitted or incorrectly provided;
4. Where the registration may violate applicable laws and regulations or is otherwise considered likely to undermine public order or generally accepted standards of conduct;
5. Where the user has previously lost eligibility under Article 24, Paragraph 2; provided, however, that this restriction will not apply where at least one (1) year has passed since such loss of eligibility and Ronald McDonald House Korea has approved the user's re-registration;
6. Where the user otherwise fails to satisfy the account registration requirements established by Ronald McDonald House Korea; or
7. Where an individual under the age of 14 applies to register as an individual user or social login user.
Article 9. Changes to Account Information
Users must update any changes to the information provided during account registration in accordance with the procedures and methods specified by Ronald McDonald House Korea.
Chapter 3. Use of Services
Article 10. Service Availability
In principle, the services are available twenty-four (24) hours a day, seven (7) days a week, throughout the year, unless there are operational or technical reasons that prevent their availability.
Ronald McDonald House Korea may temporarily restrict access to the services where necessary for scheduled system maintenance or other operational reasons, after providing prior notice to users.
Where the services are interrupted for reasons beyond the reasonable control of Ronald McDonald House Korea, access may be restricted without prior notice.
Ronald McDonald House Korea may divide the services into separate categories and establish different hours of availability for each category. In such cases, the relevant details will be announced on the website.
Article 11. Provision of Information and Advertising
Ronald McDonald House Korea may provide various information to users through the website, email, postal mail, or other appropriate means in connection with the operation of its services.
Service-related communications, including account registration confirmations and donation processing updates, may be sent to the email address provided by a user regardless of whether the user has consented to receive newsletters and activity updates.
Newsletters and activity updates will be sent only to users who have consented to receive such communications. Users who withdraw their consent will be removed from the relevant mailing list.
Ronald McDonald House Korea may display advertisements on the website, service pages, through SMS, email, or other channels in connection with the operation of its services.
Any communication or transaction between a user and an advertiser arising from the user's interaction with advertisements displayed through the services is solely between the user and the advertiser. Ronald McDonald House Korea will not be responsible for resolving any dispute arising between a user and an advertiser.
Article 12. Removal of Posts or Content
Ronald McDonald House Korea may remove, without prior notice, any content posted or transmitted by a user through the services, including content exchanged between users, where Ronald McDonald House Korea determines that the content:
1. Defames, disparages, or otherwise damages the reputation of Ronald McDonald House Korea, another user, or a third party;
2. Contains or distributes information, text, images, or other materials that violate public order or generally accepted standards of conduct;
3. Is associated with criminal activity;
4. Infringes the copyrights or other rights of Ronald McDonald House Korea or a third party;
5. Exceeds the posting period established by Ronald McDonald House Korea under separate service guidelines;
6. Is unrelated to the services provided by Ronald McDonald House Korea;
7. Contains unnecessary or unauthorized advertising or promotional materials; or
8. Otherwise violates applicable laws, regulations, or guidelines established by Ronald McDonald House Korea.
Ronald McDonald House Korea may establish separate guidelines governing posts and other content. Users must post or remove content, including content exchanged between users, in accordance with such guidelines.
Article 13. Copyright in User Content
• Copyright in content posted by a user through the services, including content exchanged between users, remains with the user. Ronald McDonald House Korea has the right to display such content as part of the services but will not use it for other purposes without the user's consent.
• Ronald McDonald House Korea will not be liable for civil or criminal claims arising from a user's infringement of another person's copyright, software copyright, or other intellectual property rights through content posted on the services.
• If Ronald McDonald House Korea becomes subject to a claim for damages or other legal action by a third party as a result of a user's infringement of such rights, the user must make reasonable efforts to hold Ronald McDonald House Korea harmless. If Ronald McDonald House Korea is not fully released from such liability, the user will be responsible for any resulting damages incurred by Ronald McDonald House Korea.
• Ronald McDonald House Korea may remove content posted by a user where the user deletes their account or where the service use agreement is otherwise lawfully terminated.
• Copyright in materials created by Ronald McDonald House Korea belongs to Ronald McDonald House Korea.
• Users may not commercially exploit information or materials obtained through the services, including by modifying or selling such materials, or permit a third party to do so. Any infringement of copyright in connection with posted content will be governed by applicable laws and regulations.
Chapter 4. Account Deletion and Restrictions on Service Use
Article 14. Account Deletion
A user who wishes to terminate the service use agreement may request account deletion through the website or by another method specified by Ronald McDonald House Korea.
Users may terminate the use of their account by following the account deletion procedures provided on the website.
Account deletion and cancellation of recurring donations are handled separately. Deleting an account does not automatically cancel an active recurring donation. A user who wishes to discontinue a recurring donation must complete the separate recurring donation cancellation process.
For recurring donations made through Foreign Card Donation, users may request cancellation by email to Ronald McDonald House Korea. The cancellation will be processed after the request has been reviewed by an administrator. Once the cancellation has been completed, no further recurring payments will be processed.
Article 15. Restrictions on Service Use
Ronald McDonald House Korea may terminate the service use agreement or suspend a user's access to the services for a specified period without prior notice if the user:
1. Engages in conduct that violates public order or generally accepted standards of conduct;
2. Engages in conduct associated with criminal activity;
3. Plans or uses the services for purposes that may harm national or public interests;
4. Uses another person's User ID or password without authorization;
5. Damages another person's reputation or causes harm to another person;
6. Registers multiple accounts using different User IDs;
7. Infringes another person's copyright or other rights;
8. Disrupts the proper use of the services through hacking, distribution of computer viruses, or other harmful activities; or
9. Otherwise violates applicable laws and regulations or the conditions of use established by Ronald McDonald House Korea.
Where Ronald McDonald House Korea terminates a user's service use agreement or suspends access to the services, Ronald McDonald House Korea will notify the user in advance. However, prior notice may not be provided where immediate suspension is necessary.
A user who has been notified of a suspension may raise an objection to the suspension.
Where Ronald McDonald House Korea confirms that the reason for the suspension has been resolved, access to the services will be restored without delay.
Chapter 5. Liability and Other Matters
Article 16. Liability for Damages
Where Ronald McDonald House Korea suffers damages as a result of a user's violation of these Terms of Use, the user will be liable for the damages resulting from such violation.
Where Ronald McDonald House Korea becomes subject to a claim for damages, lawsuit, or other claim by a third party as a result of a user's unlawful conduct or violation of these Terms of Use in connection with the services, the user will be responsible for resolving such claim at the user's own expense and for holding Ronald McDonald House Korea harmless.
If Ronald McDonald House Korea is not fully released from such liability, the user will be responsible for any resulting damages incurred by Ronald McDonald House Korea.
Article 17. Disclaimer of Liability
• Ronald McDonald House Korea does not guarantee the accuracy, reliability, or completeness of information, materials, or other content posted by users on the website.
• Ronald McDonald House Korea will not be liable for a user's failure to obtain anticipated benefits from the use of the services, or for damages resulting from materials or information obtained through the services.
• Ronald McDonald House Korea has no obligation to intervene in disputes arising between users or between a user and a third party through the services and will not be liable for damages arising from such disputes.
• Ronald McDonald House Korea will not be liable for interruptions or difficulties in using the services that are attributable to the user.
• Ronald McDonald House Korea will not be liable for failure to provide the services due to natural disasters or other circumstances beyond its reasonable control.
Article 18. Jurisdiction
If a dispute arises between Ronald McDonald House Korea and a user in connection with the use of the services, both parties will make good-faith efforts to resolve the dispute through mutual consultation.
If the dispute cannot be resolved through such consultation, either party may bring an action before a court of competent jurisdiction in accordance with the Civil Procedure Act.
Supplementary Provision
These Terms of Use are effective as of September 1, 2013.
